Section 816.116 Ibl Continued. <br />of responsibility for revegetation shall commence at the date of initial planting of the <br />crop being grown. Production shall not be considered equal if it is less than 90 <br />percent of the production of the approved standard with 90 percent statistical <br />confidence. <br />(ivl On areas to be developed for fish and wildlife management or forestland, success <br />of vegetation shall be determined on the basis of tree, shrub or half-shrub stocking and <br />ground cover. The tree, shrub, or half-shrub stocking shall meet the standards <br />described in Section 816.117. The area seeded to a ground cover shall be considered <br />acceptable if it is at least 70 percent of the ground cover of the reference areas with <br />90 percent statistical confidence or if the ground cover is determined to be adequate <br />to control erosion by the regulatory authority. Section 816.116(b) shall determine the <br />responsibility period and the frequency of ground cover measurement. <br />Equality Between Success Standard and Revegetated Areas <br />Herbaceous cover and productivity of living plans on revegetated areas will be <br />• evaluated relative to the 90 percent confidence interval for Kerr Mine and Tipple <br />Areas. All revegetated areas will be monitored and sampled using the methods <br />described in Section 779.19. Reclaimed and reference area vegetation data will be <br />evaluated using a standard statistical test, as described on page 816-156a, to <br />determine if any differences are statistically significant. <br />Vegetation Liability Period <br />Average annual precipitation for the permit area is less than 26 inches, as described in <br />Section 779.18; thus, the period of extended responsibility will continue for not less <br />than 10 years.
