Oehler, Environmental Protection Specialist ~ <br />RE: File No. M-97-054, Adequacy Items <br />The following items must be addressed by the applicant in order to satisfy the applicable <br />requirements of C.R.S. 34-32.5-101 et seq. and the Mineral Rules and Regulations of the Mined <br />Land Reclamation Boazd: <br />EXHIBIT C -Pre-Minin¢ andEXHIBITC Pre- and Mining Plan Mans of The Affected Lands <br />1. You have marked the permit area boundary with a heavy dark line on your Pre-Mining Plan <br />Map. In accordance with Rule 6.2.1(d), identify the line either on the map or the map index. <br />The Pre-Mining Plan Map should be relabeled Pre-Mining/Mining Plan Map since it shows <br />the mining operation as well as pre-mining conditions. This information can also be <br />provided on two separate maps. <br />2. Please identify the owner of the lands immediately south of the proposed permit boundary <br />and within 200 feet of lands to be affected by the mining operation. This is the land on the <br />Pre-Mining Plan Map displaying no ownership symbol and lying along the route of the <br />Arkansas River between land belonging to Mark Brown and the east map boundary. <br />3. Are there any utilities located in the railroad right-of-way? If so provide information in <br />appropriate exhibits. <br />4. Are there any wells located in the proposed permit area or within 200 feet of the affected <br />land boundary? If so, show them on a revised "Pre-Mining and Mining Plan Map." <br />5. Your Pre-Mining Plan Map shows estimated maximum floodplain boundaries for <br />Tallahassee Creek; however, there is no explanation in the application of what level of storm <br />event the boundaries are for. Fora 112 permit application the 100-year flood plain must be <br />delineated, if there is some concern that a portion of the operation may be within the <br />floodplain. If a generally acceptable hydrologic method was used to determine the <br />floodplain boundary, please provide it in Exhibit G, with documentation to support the <br />location of the boundaries. Please mark the 100-year floodplain boundary on this map if you <br />have not done so. <br />6. Please be aware that Gravel Expansion Blocks l and 2 and Quarry Expansion Blocks 1 and 2 <br />are not considered to be a part of this application. For the sake of clarification and to reduce <br />confusion in the future, please remove them from the Pre-Mining and Mining Plan Map. <br />
