rather than a proposed overall 3:1 slope in a step
configuration. Battle Mountain's response disregarded the MLRD
request. It stated that it will grade all outslopes tc an
overall 3.1 outslope with approximately outslopes of 2.8 and 15
foot dozer width bench every 50 feet in vertical height.
III. BATTLE MOUNTAIN HAS FAILED TO MEET MLRD'S CONCERN OVER
VARIOUS DESIGN FEATURES.
A. The Secondary Soil Liner Is Inadequate.
MLRD's Point No. 28 suggested that Battle Mountain not
use a soil bentonite liner as a secondary liner for the leap heap
because the soil liner may be eroded by the percolating cyanide
solution. Battle Mountain's response was that a secondary soil
liner is appropriate because the local soils are easily and
economically amended using powdered bentonite to produce a soil
liner. Battle Mountain did not explain why it will not use a
geomembrane as a secondary liner.
In Point No. 29, MLRD again suggested that a secondary
soil liner is inappropriate. However, MLRD stated as an
alternative that it will require Battle Mountain to document a
liner permeability of 1x10-6 centimeters per second in the
secondary soil liner. Battle Mountain's response is that
permeability test results will not be available for 3 to 7 days
after the soils are compacted in place. Battle Mountain stated
-14-
