BATTLE MOUNTAIN HAS FAILED TO MEET MLRD'S CONCERN OVER <br />VARIOUS DESIGN FEATURES. <br />A. The Secondary Soil Liner Is Inadequate. <br />MLRD's Point No. 28 suggested that Battle Mountain not <br />use a soil bentonite liner as a secondary liner for the leap heap <br />because the soil liner may be eroded by the percolating cyanide <br />solution. Battle Mountain's response was that a secondary soil <br />liner is appropriate because the local soils are easily and <br />economically amended using powdered bentonite to produce a soil <br />liner. Battle Mountain did not explain why it will not use a <br />geomembrane as a secondary liner. <br />In Point No. 29, MLRD again suggested that a secondary <br />soil liner is inappropriate. However, MLRD stated as an <br />alternative that it will require Battle Mountain to document a <br />liner permeability of 1x10-6 centimeters per second in the <br />secondary soil liner. Battle Mountain's response is that <br />permeability test results will not be available for 3 to 7 days <br />after the soils are compacted in place. Battle Mountain stated <br />-14- <br />
