Mr. Nelson Selcer <br />Adequacy Review, Permit Application No. M-2006-060 <br />October 24, 2006 <br />Rule 6.4.5 Exhibit E -Reclamation Plan <br />6. In the Reclamation Plan, the applicant indicates that topsoil will be replaced ".,.to a depth of at least 4" to 6" in <br />preparation of a uniform seed bed: ' Based on soil infortnation provide in the permit application, the soil overlying the <br />gravel resource varies from six inches to 3 feet. Therefore, in order to provide the greatest probability of success in <br />plant establishment, the Division requests that the applicant commit to replacing at least eighteen (IS) inches of <br />topsoil subsoil over reclaimed areas. <br />Rule 6.4.7 Exhibit G -Water Information <br />7. In accordance with Rule 6.4.7{3), please provide an estimate of the project water requirements including flow rates <br />and annual volumes for the development, mining and reclamation phases of the project. <br />8. In accordance with Rule 6.4.7(4}, please indicate the sources of any water to be used in the mining and reclamation <br />phases of the operation, and projected amount from each source. <br />9. In accordance with Rule 6.4.7(5), affirmatively state whether or not the operator has acquired or applied for a National <br />Pollutant Discharge Elimination System (NPDES) permit from the Water Quality Control Division at the Colorado <br />Department of Health. <br />Rule 6.4.19 Exhibit S -Permanent Man-made Structures <br />10. Itt accordance with Rule 6.4.19(c), letters from utility companies documenting "no negative effect" on their utility <br />from mining, must be notarized. Therefore, please have the letter from WAPA notarized and resubmit it to the <br />Division. In addition, since JCR is a permanent man-made structure, please obtain and submit a notarized agreement <br />from Jackson County that meets the criteria set forth in Rule 6.4.19. <br />Please be advised that the permit application for the BLM West Gravel Pit may be deemed inadequate and the permit <br />application denied on October 30, 2006 unless the above-mentioned adequacy review items are addressed to the <br />satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can grant an extension to <br />the decision date. This will be done upon receipt of a written waiver of your right to a decision by October 30, 2006 and <br />request for additional time.
