r • • <br />• Page 3 June 24,1999 <br />Exhibit S :Permanent Man-Made Structures <br />8) Notarized letters of agreement from various owners of nearby man-made <br />structures are attached. <br />he mining agreement with Greeley 1/Vater and Sewer Department is still in <br />progress. The Application for Special Review for this project is pending final <br />approval by Larimer County Board of Commissioners; we expect that <br />permission to mine within 200 feet of their roadways will be a part of their <br />pproval process~The Applicant agrees to not mine closer than 200 feet o4/~ <br />the man-made structures of these two entities until these agreements have <br />been obtained, and submitted to the DtiIG. <br />As requested, a more detailed discussion of the underlying bedrock is given below. <br />According to the USGS Geologic, Biostratigral~hic, and Structural Map of the Pierre <br />Shale between Loveland and Round Butte, the: bedrock beneath the site is classified <br />as an unnamed shale (upper) unit of the Piern: Shale, symbol Kpmu. Thjs map (1- <br />1700) indicates a sandstone (middle) unit witl-in the Pierre Shale, Kpms, is present <br />west of the property. However, the drill holes on the property encountered only <br />"weathered claystone".
