ltlMr. David Berry
July 15, 1985
Page Three
r d. Ditch - Records at the State Engineer Office and
consultation with the Weld County Water Commissioner
signify the Head Gate was removed, the river changed
course, and this is an abondoned ditch. rA person would
have to refile with the State Engineer to m ke this ditch
legally active. The landowner grants permission for
removal of this ditch. It is believed that since the
ditch in inactive and no party is responsible for or owns
it, the landowner has this right. The Weld County Water
Commissioner is checking on this now. A letter to this
effect will be forwarded when available.
Jx% (ye. Approval of mining within 200 feet of Weld County Road 15
will be forwarded when available.
r
rp ` Mining will come no closer than 200 feet of these
structures until permission is granted and forwarded t
1 F your office. f
`v 100
. Mining will not exceed 100 feet from the St. .Vrain Creek.
Minimal disturbance may occur around the ponds and this has
\ \ been included in the Reclamation Costs - shoreline width — v Biec
J calculated at 50 feet, more than adequate for the disturbance
likely to take place. rs
JK3. Your understanding of the 50 foot setback measured from the
top of the pond 3H:1V slopes to the permit boundaries is
correct.
(V4. The areas South of St. Vrain Creek are old meandering
channels of the creek as still inidcated on the 1979 Quad
Map. These areas are dry during periods of the year and wet
during others depending upon environmental and water table
fluctuations.
JV5. Refer to enclosed map. '
EXHIBIT C - MINING PLAN MAP 1dd
The S.C.S. Soils Report is inaccurate due to the river
changing course and local scouring over the years. • An
average of 6 inches of poor quality exists at this
time. Topsoil will be replaced at 8-10 i cfi depth.
f2. Topsoil will be stored at the 'Plant Site during Phases III,
IV and V.
"'z'-1'==. a.*SaSc.s. .:,.&:a':r
