i 1 • • <br />' Rule 6.2 Water <br /> a. Disturbances to the prevailing hydrologic balance of <br /> the affected land and of the surrounding area and to the <br />' quality of water in surface and groundwater systems <br /> during mining, reclamation and after will be minimized. <br />' 1. Any requirements for water useage is covered by I <br /> water rights as discussed in Exhibit G, Water I <br /> l <br />Information. <br />' 2. All Federal and Colorado laws and regulations <br /> governing water quality will be complied with. <br /> 3. There will be no dredge and fill requirements <br /> as pertain to navigable waters associated with <br /> this operation. <br />' <br /> 4. This operation will require no additional large <br /> siltation structure from drainways. NPDES <br /> Permit No. CO-001384 is valid for discharge from <br /> the settling lagoons into Clear Creek. See <br /> Exhibit N for copy. <br />~ ' b. If it is determined that the reclaimed area will be used <br /> as a municipal water storage, earth dams may be constructed <br /> to develop the area as a water storage facility. These <br />' dams will be engineered structures subject to all appropriate <br /> requirements of the State of Colorado. Such a change to the <br /> reclamation plan will be submitted as an amendment to the <br />' MLRB. <br /> Rule 6.3 Wildlife <br /> Exhi bit H contains the impact statement. <br /> Rule 6.4 Topsoiling <br /> <br /> a. Topsoil has been stockpiled in the area between Phase I and <br /> II (see Exhibit C). A volume of approximately 25,000 cubic <br /> yards has been determined to be satisfactory as a growth <br />' medium. The mining, and leveling operation will include <br /> dispersing this material in a minimum 4" thickness. <br /> Existing vegetation prevents wind or water erosion until <br />' redistribution. <br /> b. Woody vegetation will be removed from the pit areas during <br />' grubbing operations. Material useable as firewood will be <br /> stacked in piles around the periphery of the site. <br /> c&d. If it is determined in the future that additional topsoil <br />' stockpiles (if any) will remain for a long enough time period <br /> that would allow vegetation, a fast growing cover will be <br /> planted. The type of covex will be as advised by the local <br />' Soil Conservation Service Official. <br /> <br />
