c)(iii) If you agree with the NRCS (Mr. Kot) seeding rates, seed mix, mulch and <br />seedbed preparation proposal, then state your commitment to follow NRCS <br />recommendations. <br />c)(VI) You need to clarify this statement. Do you plan to plant 20-30 trees per acre? <br />What kind of trees? You say "most will self vegetate." I agree that the Aspens <br />will regenerate; in time. However, the site needs to be stabilized soon after <br />mining ceases; and it is imperative that the disturbed areas are adequately <br />revegetated right away so they don't experience erosion problems. A lack of <br />vegetative cover can be problematic. It is not necessary to plant trees on this site <br />in order to achieve the proposed post-mining land use (Rangeland). However, if <br />you propose to plant trees, you will need to provide the above noted information, <br />2) The financial warranty requirement will be reviewed after the application is <br />ready to approve in order to ensure that all reclamation items are addressed. As <br />stated in pazagraph (b}, "alI items referenced in the Reclamation Plan must be <br />included in the cost calculation." So far, the items needed to reclaim the 1 acre <br />disturbed area would include: replacement of topsoil/growth medium, soil bed <br />preparation, seed mix cost, labor to seed the disturbed azea, mulch and jute <br />netting, labor to place the mulch and netting, equipment mobilization and <br />demobilization and transportation of the laborers, Possible additional items: <br />purchase 20-30-trees (species unknown) and labor to plant the trees. Profit, <br />overhead and administrative costs are added to the direct costs. <br />For some unknown reason you went from Rule 6.3 to Rule 6.4 which applies to 112 Regulaz <br />permits. You failed to submit the following Exhibits: <br />A) Rule 6.3.8 - Exhibit H -Municipalities Within a Two Mile Radius. <br />B) Rule 6.3.9 - Exhibit I -Proof of Filing with County Clerk (however, you did submit proof <br />that you complied with this section so all you need to do is submit a coversheet for this <br />Exhibit and the DMG will place the proof document you submitted with the coversheet). <br />C) Rule 6.3.10 - Exhibit J -Proof of Mailing of Notices to Boazd of County Commissioners <br />and Soil Conservation District (again, you have submitted proof that you complied with <br />this section so you just need to submit a coversheet for this Exhibit). <br />D} Rule 6.3.12 - Exhibit L -Permanent Man-Made Structures -You need to comply with <br />this Exhibit in regard to the fences (if you do not own them). <br />This is a lengthy adequacy letter. If you need additional time to review and respond to the <br />DMG's concerns, beyond the current decision due date of February 27, 2002, you may request <br />an extension of the decision due date, up to 365 days from the date the application was filed with <br />the Division. Remember, if you do not request an extension of the decision due date, and you <br />have not adequately addressed the above noted concerns by the current due date, the application <br />may be denied. <br />
