Walther
Executive Director
Michael B. Long
Division Director
The Division completed a technical review of your new 110 Limited Impact Permit application.
In order to comply to the minimum requirements of the Hardrock Act/Rules and Regulation, the
following items need to be addressed:
1) Rule 6.3.1 - Exhibit A -The legal description in this exhibit should agree with Page 3 of
the application so the description should be the NE 1/a {instead of the NE 1/41/4) of the SW
1/a. Please make the correction and resubmit the Exhibit.
2) Rule 6.3.2 -"Exhibit B -You refer to the site location as the NE 1/41/4 of the SW quarter.
As noted above, it should be the NE 1/a of the SW 1/a to be consistent with Exhibit A and the
application. Please make the correction and resubmit the Exhibit.
a) You did not provide a description of the vegetative cover or the soil
characteristics that exist at this site. Obviously, the undisturbed areas of the
proposed permit azea contain several grass species as well as Aspen and fir trees.
This information needs to be included in this Exhibit. Mr. Kot's submittal did not
provide the right information. His submittal pertains, primazily, to reclamation.
b} You state that there aze no permanent man-made structures within 200 feet of the
proposed permit azea. However, a barbed wire fence was observed on the south
and west sides of the existing permit azea during a previous inspection. Also, you
have identified fences on Exhibit E map. A fence is considered aman-made
structure so this item must be addressed pursuant to Rule 6.3.12 - Exhibit L.
3) Rule 6.3.3 - Exhibit C -Explain what "ongoing from m-81-193" means.
a) Do you plan to operate year-around or will you operate intermittently (less than
180 days per year)? Please provide detailed information about your operating
plans. Do you plan to leave the tents, trailers, etc. on site if you shut down for
winter?
