• APPENDIX A • <br />WATER RIGHTS EVALUATION <br />Surface water rights appurtenant to the mining site in- <br />clude 11.5 shares of the Lower Clea. Creek Ditch Company, <br />1 share of the Colorado Agricultural Ditch Company and <br />31 shares of the Brantner Ditch Company. These water rights <br />have been used in past years to irrigate crops on 371 acres <br />of the mining site. <br />Table A lists information pertaining to decrees attached <br />to the Lower Clear Creek Ditch Company. The right is No.18 <br />priority on Clear Creek and hence, is ~derately senior. <br />Table B shows the diversions by the ditch during 1954 and <br />from 1961 through 1970. During theses eleven years the ditch <br />diverted an average of 9,200 acre-feet per year. During <br />1954, a critical, dry year, the ditc:i diverted 7,380 acre- <br />feet which is approximately 8Uo of the average annual <br />diversion. The reduced diversion during 1954 indicates <br />the ditch was placed under call by more senior water rights <br />or the diversions were limited by availability of water <br />at the ditch headgate. <br />Tiie Lower Clear Creek Ditch Company has is~ueu 375 <br />shares. Each share is entitled to a pro-rata share of <br />the diversions by the '~.tch. During the period of record <br />shown in Table B the 11.5 shares of the ditch co.~~pany appur- <br />tenant to the mining site were entitled to an average de- <br />livery of 282.1 acre-feet. less transmission loss The <br />water was used to irrigate curn on 80.4 acres as shown in <br />Figure 4 Calculations by the Blaney-Griddle method in- <br />dicate corn in the Henderson area would consume 1.89 feet <br />of water per year. The total consumptive use of 80.4 acres <br />of corn is 151.95 acre-feet of ditch water per year. The <br />irrigation consumptive use is 118.2 acre-feet per year. Eaci1 <br />share of Zower Clear Creek Ditch Company from this property <br />would yield 10.3 acre-feet of irrigation consumptive use <br />water per year. <br />The one share of the Colorado Agricultural Ditch Company <br />ar~urtenant to the mining site enables conveyance of water <br />to the site which is diverted by the Lower Clear Creek Ditr' <br />The share is not entitled to water diverted by the Colorado <br />Agricultural Ditcn. <br />Table B-lists informatio,~ pertaining to the four decrees <br />in the Brantner Ditch, which are owned by the New Brantner <br />Extension Ditch Company. The water rights were conveyed to <br />the New Brantner Extension Ditch Company in a contract made <br />with the Brantner Ditch Company. The Brantner Ditch Company <br />retained the first priority to water flowing in the ditch to <br />irrigate specified lands under the ditch owned by share- <br />holders in the Brantner Ditch Company.
