II 9II <br /> Comments on letter from <br /> Department of the Army <br /> Omaha District Corps of Engineers <br /> Permit Branch , letter dated <br /> June 4, 1984 <br /> In response to our inquiry as to whether a 404 <br /> permit will be required for the Bailey Pit, the <br /> Corps has indicated that such a permit is not <br /> required . <br /> We note the second paragraph of the Corps ' <br /> response in which two provisions are listed: <br /> 1 . " . . . .provided the excavation material will <br /> not encroach into St. Vrain Creek. " <br /> Response: The mining plan clearly indicates <br /> there will be no encroachment into St. Vrain <br /> Creek . <br /> 2 . "If a hydraulic dredge will be used, returns <br /> into the creek may require a permit . " <br /> Response: A hydraulic dredge is not one of the <br /> mining methods proposed.
