inappropriate, and Hayden Gulch Terminal, Inc. submitted a new application <br />• (dated December 16, 1992) to operate the coal loading facility pursuant to <br /> the Regulations of the Colorado Mined Land Reclamation Board for Coal <br /> Mining. <br />At the time of the December 1992 permit application submittal, HGTI <br />anticipated coal shipment commencing as early as June 1993. Permits or <br />permit applications required to operate the loadout facility were <br />transferred from the previous owner through the applicable regulatory <br />authority. The permitted coal processing capacity remained at 1.0 million <br />tons per year. <br />Because no additional operational disturbances were anticipated and <br />operational aspects will be consistent with past practices, environmental <br />assessments and operational findings contained in reviews of the previous <br />owner's permit (H-G Coal Company, Permit C-80-003) were directly applicable <br />to HGTI's permit application and future operation of the facility. An <br />additional 8.4 acres of disturbance was proposed at the time final <br />reclamation will be conducted to accommodate grading activities (i.e „ <br />. slope reduction). <br />Peabody Coal Company operated the loadout for HGTZ from January 1993 to <br />July 1994. Seneca Coal Company operated the loadout from July 1994 to <br />August 1996. HGTI has operated the loadout since September 1996. <br />On November 3, 1997, HGTI notified the DMG that the Hayden Gulch Loadout <br />had been put into temporary cessation as a result of HGTI or its affiliates <br />not having an existing mine requiring the use of a loadout facility at that <br />time. Zn July 2000 the loadout was returned to active status as part of <br />Technical Revision TA-O5. TA-O5 was filed with the DMG to upgrade the <br />loadout facility to provide for railcar unloading (or load-in) in addition <br />to the permitted railcar car and truck loadout operations. The technical <br />revision provided for greater flexibility in the operation of the facility <br />and potentially provided for increased facility longevity. However, <br />anticipated market conditions, which prompted the load-in technical <br />revision, did not materialize and HGTI again placed the facility in <br />temporary cessation on October 14, 2001. <br />• Since October 2001, HGTI has been exploring market opportunities that might <br />include the loadout operations and has identified several opportunities <br />2 Revised 3/20/03 <br />
