The applicant has an adequate Parshall Flume to measure <br />the amount of water to be released to the river according <br />to our Division Engineer who inspected the applicant's <br />property. <br />5. In order to assure that this plan is legally binding upon <br />the applicant or subsequent owners of this property and <br />that this plan is as nearly permanent as the uncontrollable <br />evaporation that will occur if this operation is permitted, <br />we recommend that the applicant submit his plan of augmen- <br />tation to the Division Water Court. We realize that this <br />Water Court action may take up to 18 months to obtain <br />approval and that the applicant cannot afford to wait for <br />this period of time; therefore, we would suggest that a <br />condition of approval be included with the permit that the <br />applicant obtain Water Court approval of his plan within <br />2 years unless extenuating circumstances are provided which <br />would permit an extensio of an ditional year. <br />~ Q l <br />J ris A.
