_7_ <br />• <br />• Permit No. 76-56 <br />1. lluring the course of minim operations, STERLING RF.P.DY ~lI}: CONCFL•'IE CO. <br />shall not allow the total disturbed acreage to e::ceed the following limitations: <br />Ptajor Disturbance 5 acres <br />Moderate Disturbance 3 acres <br />Minor Disturbance 2 acres <br />For purposes of this condition, major disturbance, moderate disturbance, and <br />minor disturbance are defined as follot.~s: <br />hfajor Disturbance - that area of a mining operation which includes e::cavations, <br />overburden spoils, and topsoil stockpiles. <br />Poderate Disturb azue - that area of a mining operation which is a result <br />of backfilling of the open cut, the levelling of overburden spoils, the <br />smooth grading and the distribution of topsoil or other sui[able, approved <br />plant .growth medium. <br />idinor Disturbance - that area of a mining operation which is undergoing pre- <br />paration immediately prior to planting, or sending, is being planted or seeded, <br />or has been planted.or seeded but will not be released from bond until there has <br />been full completion of all reclamation requirements as set forth in the permit. <br />2. STERLING f2l;ADY MIX CONCRETE CO. agrees to comply with all rules and regulations <br />to be adopted as regulations by the 19ined Land Declamation Board pursuant to its <br />authority under Article 32 of Title 34, C.R.S. L973, as amended (1976 Sess. Laws <br />H. G. 1065} which are not declared invalid, inapplicable, or mtenforceable by <br />statutory or court action, as soon as possible, buc not later than i80 days after <br />the effective date of such regulations. Pending the adoption of such rules and <br />regulations, STERLING F]iADY DIIX CONCRETE CO. agrees to be bound by all of the pro- <br />visions of the 1976 Afined Land Reclamation Act, as well as the rules and regulations <br />of the Mined Land Reclamation P,oard previously adopted under the Colorado Open <br />Paining Land Feclamation Act of 1973. Further more, once the rules and regulations <br />are adopted by the Board, STERLING READY MIX CONCRETE CO. agrees that all documents <br />it submits to comply with such rules and regulatious will be subject to Eu11 public <br />review and that full opportunity will be given Cor a hearing before the Board on <br />the adequacy of the documents, if requested in writing by members cf the public. At <br />such a hearing, the Board may reconsider further conditions to this permit. This <br />condition is more fully set forth in the stipulation and agreement applicable to the <br />open mining life of the mine permit, No. 76-56, issued on February 23, 1977 to <br />STERLING READY PIIX CONCFG'LE CO. <br />This permit is issued subject to all requirements of the Colorado Mined Land <br />Feclamation Act and all rules, regulations and standards now in force and any <br />which may in the future be promulgated by the Mined Land Feclamation Board, and <br />this permit may be revoked or suspended for noncompliance with the e\ct and/or such <br />rules, regulations and standards. <br />MINED LIu`1D RECLAPU\T ION BOARll <br />ay ~~._, :1. . ~ ,~_t. <br />.~, <br />
