., <br />Mr. John Jordan -S- July 18, 1995 <br />Tuttle Applegate, Inc. <br />What is the backfilling schedule for the backfilled portions of Phases 3, 4, 5, 6 and 7? How <br />much material will be needed, and where will it come from? <br />If, as the Division assumes, the worst case will be at the end of Phase 2, not only will the <br />entire inside of the perimeter of the liner trench have to be backfilled, graded and topsoiled, but <br />the liner will have to be installed and the outside perimeter, over the liner, will also have to be <br />backfilled, graded and topsoiled. In addition, the liner along the west side of the pit will have <br />to be buried. <br />In addition to topsoiling the 3H:1V slopes azound the pit perimeter, the Phase 1 azea, which <br />will be lefr above the water surface, will have to be topsoiled and seeded. <br />Additional costs are also anticipated for filling wash ponds and sediment ponds, removing <br />culverts and associated asphalt batch plant structwes and/or materials, and pumping mine water <br />out while liner work and/or backfilling and grading is being done below the groundwater table. <br />If the applicant cannot demonstrate adequate water storage rights as discussed in Section 4(d) <br />of this letter, the reclamation cost must also include funds to purchase adequate water to fill the <br />reservoir one time. <br />Please submit a revised estimated reclamation cost incorporating the above comments, concerns, and <br />questions. As provided for under Rule 1.8.1, all changes and additions to the permit application <br />must be filed with the Division and with the County Clerk and Recorder. The applicant shall also <br />provide the Division with an affidavit or receipt demonstrating that the change was filed with the <br />County Clerk and Recorder not later than the close of business on the day the change was filed with <br />the Division. Any change or addition to an application shall constitute an amended filing for <br />purposes of determining the date for the consideration of the application by the Division, and for <br />the deadline for a fmal decision on the application. If the Division determines that additional time is <br />necessary to afford the Oftice an adequate opportunity to review the changes, a new decision date <br />must be set within five (5) working days of an amended filing, as detailed in Rule 1.8.4. <br />If you have any questions, please feel free to contact me. <br />Sincerely, <br />Gregg R.
