<br /> <br />Mr. John Jordan -4- July 18, 1995 <br />Tuttle Applegate, Inc. <br />requires an actual, task-by-task reclamation plan that is enforceable and from which a <br />reclamation bond can be calculated. <br />£ Under Water Item (d), page d, the operator has stated that all sediment an(d) siltation <br />structures shall be regraded after mining completion. Please list the structures, size <br />(length, width and depth) and methods to be used in the regrading. <br />4. Water Information -Exhibit G <br />a. In regard to the Box Elder Ditch Lateral, the ditch along the east side of the permit area <br />and the ditches on the property, please see the Division's comments under Item 2a. <br />b. During the preoperational inspection, it was noted that the Western Mobile operation, <br />directly north of the proposed site, was pumping pit water into the ditch along the east <br />boundary of the proposed site. It appears that the applicant plans to remove this ditch. <br />Where will the Western Mobile pit water be discharged if the ditch is removed? <br />c. On page 11 of the application, it is stated that Connell has located two discharge points. <br />During the preoperational inspection, it was stated that the planned north end discharge <br />will not be used. Please modify this section of the plan to reflect the new plan. Also, <br />please identify on a map the location of the south end discharge point. If a culvert is <br />required under County Road 36, the culvert must be included as part of the permit area <br />and its final disposition included as part of the reclamation plan. <br />d. On page 11 of the application, it is stated, "The Lessor shall be responsible operation [sic] <br />of the reservoir and for any leasing of water storage rights." The Division must receive <br />some documentation that the lined storage reservoir will actually be used for the proposed <br />post-mine use. Please provide documentation that the landowner has sufficient water <br />rights available to fill the reservoir and that the water can be used for this purpose. Has <br />approval been received from the State Engineer's office for this use? If so, please submit <br />documentation that demonstrates this. If not, please provide evidence that such approval <br />has been applied for. <br />5. Reclamation Costs <br />The Division would like some clarification of Table L-2 Reclamation Costs. It appears to the <br />Division that the maximum amount of back£illing, grading and construction of the liner would <br />be after the excavation of the Phase 2 perimeter (dewatering) trench and prior to the <br />construction of the liner. It has been assumed that the liner would be constructed upon the <br />completion of the excavation of Phase 2. If this is not correct, please provide a schedule for <br />the construction of this liner, including the buried liner along the west side. <br />When will the backfilled portion of Phase l be backfilled? How much material will be needed, <br />and where will the backfill come from? <br />
