<br />Vegetation will be sampled and compared to the either the <br />sagebrush/grass refeerence area or the Seneca II Mountain Shrub <br />community reference area, as previously described. Revegetation <br />will be considered successful for cover when the percent total <br />vegetation cover for the reclaimed area is greater than or equal <br />to 90~ of the total vegetation cover (excluding tree canopy cover) <br />measured for the reference area at a 90% confidence level. <br />An agreement was signed by Sun Coal Company with Peabody Coal <br />Company on October 3, 1983, outlining the vegetative monitoring <br />data that will be shared by the respective companies. The <br />monitoring program is based on three-year increments commencing in <br />1985 or 1986. The agreement stipulates, "Prior to April 1 of the <br />years in which the Monitoring Program is to be performed, Sun <br />shall notify Peabody in writing wether it desires to participate <br />in the Monitoring Program that year. If Sun so notifies Peabody, <br />Peabody shall forward to Sun a copy of its scope of work for the <br />Monitoring Program for that year. Peabody shall have complete <br />~~ management authority over the Monitoring Program, including the <br />sole right to select any consultants to be used in the Monitoring <br />Program." It further states, "Sun shall be responsible for one- <br />half of all costs and expenses of any Monitoring Program on the <br />Reference Area in which it elects to participate and shall be <br />entitled to all data collected from the Reference Area in the <br />Monitoring Programs in which it participates." <br />In accordance with CMLRD permit Stipulation, Sun Coal Company <br />will conduct revegetation monitoring in years 2, 9, and 7 after <br />seeding to evaluate the success of revegetation. This monitoring <br />will consist of quantitative evaluations of total vegetation <br />cover, herbaceous production, and, on the Eilts property only, <br />woody plant density; and qualitative descriptions of species <br />present, diversity and condition, and trend of the revegetated <br />area. The permit also stipulates that a summary report of the <br />data collected and qualitative discussion ... shall be submitted <br />to the Division by September of each monitoring year. <br /> <br />- 381 - (Rev. 9/93) <br />
