Box 535 <br />Somerset, Colorado 81434 <br />RE: Somerset Mine, File C-81-022, Permit Revision E1 <br />Dear Mr. Bear: <br />Severai days ago we spoke -ri th both you and Mr. Jim Stover of Somerset Mining <br />Company concerning Mork to be done for the railroad on their tracks and <br />railroad bed immediately adjacent to your proposed Sanborn Creek Mine. <br />• We understand that the railroad plans to move the railroad bed and tracks to <br />the. south in the area of S1/2 SW 1/4 of Section 9, T13S, R90W. This cork vri11 <br />all be done within the railroad right-of-way, wi]1 be done under agreement <br />with the railroad, and will not affect any area within the current Somerset <br />permit. 'Due to these circumstances we do not believe that there is any impact <br />to either the approved permit or the proposed revision, and that the Oirision <br />has no jurisdiction over the conduct of the moving activities.
