<br />Comment 2. Provide revised Exhibit C to include location of underground gas lines and <br />irrigation laterals within the affected land and known irrigation laterals adjacent to the affected <br />land. <br />• The Pre-mining/Mining Plan Map, Exhibit C, has been revised to include underground <br />gas pipelines and irrigation laterals. The applicant owns all irrigation laterals (lined and <br />unlined) identified within the permit boundary. Irrigation laterals identified outside the <br />permit boundary and not owned by the applicant are upgradient of the proposed site and <br />do not receive flow from the irrigation laterals within the affected area. A copy of the <br />revised plan map is enclosed in Attachment B. <br />Comment 3. Provide a revised copy of Exhibit C to demonstrate a setback distance of at least 64 <br />feet. As an alternative, the applicant may either a) provide a notarized agreement between the <br />applicant and the person(s) having an interest in the structure, that the applicant is to provide <br />compensation for any damage to the structure, orb) where such an agreement cannot be reached, <br />the applicant shall provide an appropriate engineering evaluation that demonstrates that such <br />structures shall not be damaged by activities occurring at the mining operation. <br />• An appropriate engineering analysis was performed to evaluate slope stability. Results of <br />the analysis are enclosed in Attachment R. Based on results of the analysis, new setbacks <br />have been proposed for the Tanabe site. The evaluation demonstrates that, with the new <br />proposed setbacks, structures within 200 feet of the affected lands shall not be damaged <br />by activities occurring at the mining operation. The new proposed setbacks are illustrated <br />on the revised PremininglMining Plan Map enclosed in Attachment B. However, if <br />additional boring or other testing data becomes available and further analyses and <br />evaluations suggest that the setbacks can be reduced, the applicant may pursue a technical <br />revision to the proposed permit. The applicant may also wish to provide, under a <br />technical revision to the proposed permit, a notarized agreement between the applicant <br />and the person(s) having an interest in the structure, that the applicant is to provide <br />compensation for any damage to the structure. <br />Comment 4. Provide a representative cross sectional diagram of the working pit face and <br />dewatering trench to be employed. <br />• Representative cross-sectional diagrams of a working pit face and dewatering trench are <br />enclosed in Attachment C. <br />Comment 5. Indicate if there are any permanent structures (supports) that will need to be <br />installed within the permit area as part of the overhead conveyor system.
