In a <br />letter dated October 2 (copy attached) the Army Corps of Engineers initiated <br />formal section 7 consultation on an additional depletion of 1.8 acre-feet of <br />water caused by evaporation from two proposed sedimentation ponds. <br />Technically, it is the responsibility of the Office of Surface Mining, as the <br />lead Federal agency for the project, to consult on this additional depletion <br />of water which was previously overlooked. However, in this case the issue can <br />be adequately addressed based on the Corps of Engineers correspondence. This <br />memorandum amends our September 3 Biological Opinion for the Bowie No. 2 Mine <br />to include this additional depletion of 1.8 acre-feet. <br />With respect to the depletion charge, the applicant must make an additional <br />one-time payment calculated by multiplying the project's additional average <br />annual depletion (1.8 acre-feet) by the depletion charge in effect at the <br />time payment is made. For Fiscal Year 1997 (October 1, 1996, to <br />September 30, 1997), the depletion charge is 513.41 per acre-foot water <br />depletion. Therefore, an additional payment of 524.14 is required.
