(Dorothy Anderson; June 30, 2001)
DMG Response -The applicant will backfill and grade overburden where appropriate. Available
topsoil will be salvaged and stockpiled for reclamation. The applicant will incorporate
contemporaneous reclamation where practicable.
Exhibit G -Water Information:
4. (Thomas Sauter; May 7, 2001)
DMG Response -The Bennett Sand & Gravel Pit #2 will be a "dry" pit with no groundwater
used or exposed to the surface during mining and reclamation. The operator will install a bermed
and lined fuel storage area for petroleum products that will stored on site. The storage area will
be outside the 100-year floodplain of Kiowa Creek and approximately 50 feet above the
groundwater surface.
Exhibit H-Wildlife Information:
5. "Some of our concerns regard the wild life that is in the area ... the deer that come up from the
creek ... and the bald eagle that roost in the trees. Why should all the wild life be disturbed or run
off because of this operation." (Dorothy Anderson; June 30, 2001)
DMG Response -The applicant has provided a Wildlife Impact Statement from the Colorado
Division of Wildlife. There was no evidence of any possible adverse impacts to wildlife. Also,
the applicant has provided an adequate reclamation plan to reestablish revegetation via a grass
cover.
Issues Raised Durine the Initial Public Comment Period That The Division Believes
Are Not Within The Jurisdiction Of The Division Or Board
6. Dust control - "When we have high wind conditions out here we have our share of dust. Just
how much more dust is going to be created by Mr. Lincoln with this sand & gravel operation?"
(Dorothy Anderson; May 30, 2001)
7. Noise & hours of operation - "He has [en (]0) years for this operation and none of us care [o
hear and see all his machinery operating at all hours of the day or night." (Dorothy Anderson;
May 30, 2001)
