A plan for the division of irrigation water between all lots. <br />13. A noxious weeds mitigation plan included proposed implementation and/or the following <br />plat note: Each lot owner shall be personally responsible to control undesirable, <br />noxious weeds within the boundaries of that lot, to prevent the spreading of such weeds <br />to other lands and to comply with the recommendations of the Delta County Weed <br />Board concerning the control of such weeds. <br />The following statement shall be placed on the final plat: <br />14. Engineered sewage disposal systems may be required on Lot 2. <br />15. This property is located in an agricultural area, normal agricultural activities will continue <br />unabated in the surrounding areas and may not be the basis for a lawsuit except in <br />cases of proven gross negligence. <br />Right to farm policy as follows: All development in Delta County is subject to the Delta <br />County Right to Farm and Ranch Policy, adopted as Resolution 96-R-033 by the Board <br />of County Commissioners of Delta County on December 23, 1996. <br />18. Building setbacks are 10' from side and rear {ot lines and 20' from front and no less <br />than 50' from the center line of any public road. <br />The following are requirements of all minor subdivisions: <br />1. A deed restriction and a plat note which states that Lot 2 cannot be developed or used for other <br />than agricultural uses unless the owner goes through the full subdivision review process. <br />B. Dedication of easements as requested by DMEA. <br />Mr. Volk stated that there is about 15 acres of irrigated pasture on Lot 1. The property is not good for <br />any crops as the tap soil is too shallow. It has to be irrigated to have pasture. On Lot 2 he stated that <br />there is only about 40 acres of fairly good agricultural land. The rest is river bottom rough land. <br />After discussion with Mr. Volk, Commissioner Ventrello made a motion that the Board approve Volk <br />Minor Subdivision MS 97-071 with Planning Staff recommendations.
