Stephen Albouy, representing the Smuggler Consolidated <br />Mines Corporation., hereinafter "Applicant", has applied to <br />the Board of County Commissioners of Pitkin County, Colorado, <br />hereinafter "Board", for the following land use approvals: <br />a. Subdivision and General Submission Review pursuant to <br />Sections 4-1 and 6-3 of the Land Use Code to subdivide <br />a 42 acre parcel into two lots, one of which will remain <br />in the County, and the other which will be annexed into <br />the City, and developed under the affordable housing <br />zoning regulations; This review will establish a lot and <br />building envelope for the existing legal mine development <br />on the Smuggler Mine parcel in the County. <br />b. Growth Management Exemption for the existing mine use <br />pursuant to Section 5-510.2(a) of the Land Use Code; <br />2. The Applicant's parcel is zoned AF-1. <br />3. The applicant proposes to subdivide approximately 42 <br />acres of land into two lots, one containing approximately 29 <br />acres and the other containing approximately 13 acres. <br />4. Said parcel is located off of Smuggler Mountain Road <br />northeast of Centennial in Section 7, Township 10 South and <br />Range 84 of the 6th P.M., more specifically described in <br />Exhibit "A". <br />5. The Planning and Zoning Commission heard the application <br />at their regularly scheduled meeting on March 22, 1994, at <br />which time they recommended conditional General Submission <br />
