• 1.03 Land and Rights-of-Way -Limits of Construction <br />Prior to issuance of Notice to Proceed, the Owner shall obtain all land and rights- <br />of-way necessary for carrying out and for the completion of the Work to be <br />performed pursuant to the Contract Documents, unless otherwise mutually agreed. <br />The Owner shall provide to the Contractor information which delineates and des- <br />cribes the lands owned and rights-of-way acquired. <br />The Contractor shall at all times confine his work, including storing equipment and <br />materials, on the property of the Owner as shown on the Drawings. <br />The Contractor shall provide at his own expense and without liability to the Owner <br />any additional land and access thereto that the Contractor may desire for tem- <br />porary construction facilities, or for the storage of materiels. <br />1.04 Subcontracting <br />The Contractor may utilize the services of specialty Subcontractors on those parts <br />of the Work which, under normal contracting practices, are performed by specialty <br />Subcontractors. <br />The Contractor shall not award Work to Subcontractor(s) in excess of fifty (SOSG) <br />percent of the Contract Price, without prior written approval of the Owner. <br />~• The Contractor shall be fully responsible to the Owner for the acts and omissions of <br />his Subcontractors, and of persons either directly or indirectly employed by them, <br />as he is for the acts and omissions of persons directly employed by him. <br />The Contractor shall cause appropriate provisions to be inserted in all subcontracts <br />relative to the Work to bind Subcontractors to the Contractor by the terms of the <br />Contract Documents insofar as applicable to the Work of Subcontractors end to <br />give the Contractor the same power as regards terminating any subcontract that <br />the Owner may exercise over Contractor under any provision of the Contract <br />Documents. <br />Nothing contained in this Contract shall create eny contractual relation between <br />any Subcontractor and the Owner. <br />1.05 Permits and Licenses <br />Permits and licenses of a temporary nature necessary for the prosecution of the <br />Work shall be secured and paid for by the Owner unless otherwise specified. <br />Permits, licenses and easements for permanent structures or permanent changes in <br />existing facilities shall be secured and paid for by the Owner, unless otherwise <br />specified. The Contractor shall give all notices and comply with all laws, <br />ordinances, rules and regulations bearing on the conduct of the Work as drawn and <br />specified. If the Contractor observes that the Contract Documents are at variance <br />therewith, he shall promptly notify the Owner in writing, and the necessary changes <br />• shall be made. <br />01016-3 <br />
