inflow would influence the water rights with direct decrees from Stevens fulch, <br />The only vested water right for flows directly from Stevens Gulch is the Fire <br />Mountain Canal, The Fire Mountain Canal has informed CWI that they intend to <br />abandon this water right. (see Attachment !tl) <br />Stevens Gulch is an ephemeral stream that experiences less than one month with- <br />out any flow, In the late summer and fall periods flow is minimal, Because of <br />the non-use of Stevens Gulch, the mine inflow is insignificant, Regardless of <br />that fact, CWI proposes water replacement plans for that mine inflow, <br />East Roatcap Creek <br />The maximum seepage from East Roatcap Creek is calculated at 5,4 gallons per <br />minute, CWI is assisting local water users in relocating the Overland Ditch <br />late runoff water to West Roatcap Creek so that mining effects to this water is <br />minimized, The 5,4 gallons per minute, therefore, would he affected only during <br />the runoff period lasting from April until July, During that time the 5,4 gal- <br />lons per minute would be considered insignificant, Regardless of that fact, CWI <br />proposes water replacement for that mine inflow, <br />MITIGATION PLAN <br />The subsidence-induced water replacement plans state the general philosophy of <br />CWI's water replacement plans as: <br />1. Where possible, location of coal lease boundaries and irrigation transport <br />systems like East Roatcap Creek to minimize effects, <br />• 2. Use of designated buffer areas in areas of less than 500 feet of overburden <br />in the Stevens Gulch and East Roatcap drainage basins, <br />3, Appropriate monitoring of water resources, includiny mine inflow monitoring <br />program, <br />4, Ouick repair of subsidence-induced problems, <br />5. Improvement of transportation systems to local water users on a case-by-case <br />basis, <br />6. Supplying replacement water, if necessary, <br />7, To continually evaluate other alternatives for water right users. <br />This mitigation plan far mine inflows also follows that general philosophy where <br />applicable. <br />RELOCATION <br />The East Roatcap/Overland Ditch diversion will be relocated to West Roatcap dur- <br />ing the construction season 1985. The inflow during this time will not affect <br />irrigation water use, CWI proposes water replacement only during runoff times <br />• when irrigation water is used, That time is usually during runoff season from <br />March through July, <br />
