Because EFC proposes the continued use of open <br />storage for its coal, EFC must submit additional infor- <br />mation on fugitive dust control for the stockpile. The <br />information should be in the form of a detailed plan <br />for fugitive dust control. Also, an estimate of total <br />particulate emissions (including fugitive dust by area) <br />should be supplied." <br />Copies of the Emission Permits issued to Energy <br />Fuels Corporation by the Colorado Air Quality <br />Control Division have been provided to both Mr. <br />Richard A. Mills, of the Mined Land Reclamation <br />Division and Mr. Keith Kirk of the Office of <br />Surface Mining. These permits are a matter of <br />public record and copies may also be obtained from <br />the Colorado Department of Health. During the <br />course of meetings with the Mined Land Reclamation <br />Division and Mr. Keith Kirk of the Office of <br />Surface Mining, it was understood that the provision <br />of copies of these permits would be sufficient to <br />respond to this inquiry, due to the fact that, by <br />law, these permits define and control EFC's air <br />quality compliance obligations. <br />12/18/79 Letter, p. 1, #2 <br />"2. EFC references certain reports and documents in <br />the cultural resources section. In order to facilitate <br />the technical review, the following documents and <br />information must be supplied: (a) the survey report by <br />Dr. Alan Olson, 1975, Denver University, (b) the survey <br />report by Dr. Calvin Jennings, 1975, Colorado State <br />University, (c) BLM Environmental Assessment report, <br />January, 1979, (d) BLM report for 1978 investigations, <br />(e) a map which documents which areas (sections) were <br />surveyed by which investigators, (f) provide documenta- <br />tion or surveys conducted on "adjacent areas" (OSM <br />requires a 1-mile buffer zone for fragile sites that <br />may be adversely impacted by blasting), and (g) a copy <br />of the 1978 BLM investigations." <br />See, Exhibit No. 23 <br />
