However, <br />CTL/Thompson can accept reversing the slope on the <br />bench so that the 5 pencent grade goes from the <br />outslope towards the fill and is drained around <br />the fills to the permanent diversion ditches at <br />the fill toes. <br />Exhibit 9, Figure 14, presents the bench stability <br />analysis. The factor of safety exceeds 3 which is <br />much greater than the required 1.3. <br />The information provided here along with an examination <br />of Exhibit 9 should demonstrate the terraces to be <br />in compliance with Section 816.102(b). <br />Bob Thompson of CTL/Thompson has responded to this <br />item in Supplement No. 1 which has been inserted <br />into Exhibit 9 immediately following page 28. <br />12/20/79 Memo, p. 4, #6 <br />"6. Page 816-34 reports that no permanent stream <br />diversions are planned. The South Tributary to Foidel <br />Creek meets the Federal definition of an intermittent <br />stream.
