<br />b) the elevations of the fill toe bottom, the top of the back of fill, and the slope of <br />the valley profile through that section of the valley (Table 1 of Figure 1 of Exhibit <br />13 may no longer be correct if the Fill elevations shown on Map 2.OS.4-1 aze the <br />actual planned final elevations) <br />c) the results of the individual geotechnical studies done to demonstrate compliance <br />with Section 2.05.3(6)(b), (c), and (d). (The materials provided in Exhibit 13 state <br />that the findings provided in that report are preliminary, and that further testing <br />should be done to confirm preliminary conclusions.) <br />d) the material planned for use as the filter fabric for the rock drains (Section <br />4.09.2(2)(c)). <br />e) Identify those fills which fall into CTL Thompson's category of "non-valley fills" <br />(Figure 5, Exhibit 13), for the purposes of drain construction. <br />92. On page 2.05-10, it is stated in the fifth pazagraph that overburden from the surface mine <br />will be pushed with dozers and end-dumped into the bottom of the fills. As both Sections <br />4.09.1(7) and 4.09.2(3) require spoil to be transported and placed in horizontal lifts, and <br />as the CTL Thompson report states that "the fills will be constructed from above, with <br />spoil trucked or dozed down to the fill surface", please remove any reference in the <br />application to end-dumping material into the fills. <br />93. On page 2.05-10, it is stated that "rock drains will be installed on each side of the fill to <br />catty runoff to a sediment control structure". Please change the words "rock drains" to <br />"riprapped diversion ditches", to avoid confusion with the subdrains proposed beneath the <br />fills. <br />94. Please provide the volumes of the portal backfill stockpiles. <br />95. Please provide a statement in the "Surface Blasting Plan" text, which begins on page 2.05- <br />36, that states that Lorencito Coal Company, in conducting surface blasting activities, will <br />comply with all applicable State and Federal laws in the use of explosives and <br />requirements of Section 4.08 of the Board's regulations in consultation with appropriate <br />State agencies (Section 4.08.1(1)). <br />96. Please state that all surface blasting activities will be conducted by experienced, trained, <br />and competent persons who understand the hazards involved, that persons responsible for <br />blasting operations at a blasting site will be familiar with the blasting plan and any site- <br />specific performance standards, that the blaster and at least on other person will be present <br />at the firing of a blast, and that each person responsible for blasting operations will <br />possess a valid certification in accordance with appropriate Federal and State laws <br />(Section 4.08.1(3)). <br />97. Because blasting operations will be conducted within 500 feet of an active underground <br />mine, an anticipated blast design, prepared and signed by a certified blaster (Section <br />1.04(20a)), must be submitted either as part of a permit application or at a time before the <br />blast approved by the Division (Section 4.08.1(4)(a)(ii)).
