b) the elevations of the fill toe bottom, the top of the back of fill, and the slope of
the valley profile through that section of the valley (Table 1 of Figure 1 of Exhibit
13 may no longer be correct if the Fill elevations shown on Map 2.OS.4-1 aze the
actual planned final elevations)
c) the results of the individual geotechnical studies done to demonstrate compliance
with Section 2.05.3(6)(b), (c), and (d). (The materials provided in Exhibit 13 state
that the findings provided in that report are preliminary, and that further testing
should be done to confirm preliminary conclusions.)
d) the material planned for use as the filter fabric for the rock drains (Section
4.09.2(2)(c)).
e) Identify those fills which fall into CTL Thompson's category of "non-valley fills"
(Figure 5, Exhibit 13), for the purposes of drain construction.
92. On page 2.05-10, it is stated in the fifth pazagraph that overburden from the surface mine
will be pushed with dozers and end-dumped into the bottom of the fills. As both Sections
4.09.1(7) and 4.09.2(3) require spoil to be transported and placed in horizontal lifts, and
as the CTL Thompson report states that "the fills will be constructed from above, with
spoil trucked or dozed down to the fill surface", please remove any reference in the
application to end-dumping material into the fills.
93. On page 2.05-10, it is stated that "rock drains will be installed on each side of the fill to
catty runoff to a sediment control structure". Please change the words "rock drains" to
"riprapped diversion ditches", to avoid confusion with the subdrains proposed beneath the
fills.
94. Please provide the volumes of the portal backfill stockpiles.
95. Please provide a statement in the "Surface Blasting Plan" text, which begins on page 2.05-
36, that states that Lorencito Coal Company, in conducting surface blasting activities, will
comply with all applicable State and Federal laws in the use of explosives and
requirements of Section 4.08 of the Board's regulations in consultation with appropriate
State agencies (Section 4.08.1(1)).
96. Please state that all surface blasting activities will be conducted by experienced, trained,
and competent persons who understand the hazards involved, that persons responsible for
blasting operations at a blasting site will be familiar with the blasting plan and any site-
specific performance standards, that the blaster and at least on other person will be present
at the firing of a blast, and that each person responsible for blasting operations will
possess a valid certification in accordance with appropriate Federal and State laws
(Section 4.08.1(3)).
97. Because blasting operations will be conducted within 500 feet of an active underground
mine, an anticipated blast design, prepared and signed by a certified blaster (Section
1.04(20a)), must be submitted either as part of a permit application or at a time before the
blast approved by the Division (Section 4.08.1(4)(a)(ii)). Figure 2.05.3-17 is not signed.
and does therefore not qualify as the required blast design. Please provide [his
