<br />topsoil from contour mining and from the disposal areas will be salvaged. If topsoil <br />stripping, salvaging, and replacement at the contour operations and at the disposal azeas <br />will occur in accordance with the plan described on pages 2.05-33 and 2.05-35 of the <br />application, a sentence may be placed on page 2.05-10 indicating this. <br />72. On page 2.05-40, it is stated that "Underground development waste from fault crossings, <br />overcast development, or roof rock will either be deposited in underground gob rooms or <br />be placed in the surface mine backfill". By definition (1.04(22)), underground <br />development waste is also "coal mine waste". As such, Section 4.11.3 of the Regulations <br />allows underground development waste to be returned to underground mine workings <br />("gob rooms") only in accordance with a waste disposal program approved by both the <br />Division and MSI-IA under Section 2.05.3(a) of the Regulations. Please provide this <br />information. <br />If the applicant, rather than placing underground development waste in underground <br />workings, would rather place this material in the proposed spoil fills, the information <br />required by Section 4.09.1(12) of the Regulations must be provided. <br />Rule 2.05.3(31 Mine Facilities <br />73. It is stated in the second pazagraph on page 2.05-10 that "Shale and other extraneous <br />material sepazated from the coal prior to loading will be left in the pit or placed with the <br />overburden." As the definition of "coal processing waste" (Rule 1.04(24)) is "earth <br />materials which aze sepazated and wasted from product coal...", it could be construed <br />from this sentence that "processing" of coal will occur at the surface mine prior to being <br />trucked to the loadout facility. A description of the coal processing facility or equipment <br />planned at the surface mine would then be required. If processing is not intended, <br />however, then this sentence should be reworded. <br />It should be noted that Section 4.26.2(4)(c) of the Regulations requires the top of the <br />underburden immediately below the lowest coal seam mined by mountaintop removal <br />methods to be covered with non-toxic spoil. If "shale and other extraneous material" will <br />be returned to the pit floor, those materials must be determined to be non-toxic prior to <br />their placement. <br />74. Please provide the engineering designs for the four concrete portal openings at the Pl <br />portal site, the four concrete portal openings at the P2 portal site, the four concrete portal <br />openings at the P3 portal site, the four concrete portal openings at the Rl portal site and <br />the three concrete portal openings at the R2 portal site (Section 2.05.3(3)(a)). Please <br />provide a cross section that demonstrates how faz into each hillside the concrete structures <br />will extend, and indicate the different safety bench configurations proposed. <br />75. Please provide on a map the location of all existin underground and overhead utility <br />lines, utility poles, and substations transformers. Please provide on the same map the <br />location of all proposed utility lines, poles, substations, and light-use maintenance roads <br />
