This implies these ares are small area exemptions, yet <br />there is no supporting calculations/documentation to indicate runoff does <br />not exceed effluent limitations. <br />Either the demonstrations that effluent limitations will be met must be <br />made or the piles must be included into the sediment control plan. <br />Response <br />More detailed information requested will be submitted in the upcoming <br />submittal. As built certified copies of the sediment ponds are included <br />herewith. Original designs as approved are also included with this <br />package. An emergency spillway for Sediment Pond No. l was pointed <br />out to Division Staff. Sediment storage markers will be installed in both <br />ponds. Topsoil piles have been renumbered on Table 5-3. <br />The straw bales were used to check erosion. The fill slopes are currently <br />stabilized by vegetation. A larger drainage area was originally used to <br />introduce a conservative design into the sediment calculations. The <br />sediment plan was designed without a temporary use of the pit area. The <br />text was deleted with this statement concerning how the present system <br />• works. The fact that there has never been anon-complying discharge is <br />evidence that the system functions property. <br />Oakridge was given small acreage exemptions on these topsoil piles. <br />Berms were installed to catch and retain runoff. The piles were and are <br />revegetated at this time and have no erosion problems. <br />These topsoil piles are now totally stabilized through revegetation. The <br />berms continue to exist for control of potential sediment erosion. This <br />plan represents the best control technology. <br />soon <br />2.05.3(6) Oakridge Energy, Inc. plans to conduct apre-mining survey to establish <br />horizontal and vertical control for the pit area. When will this be <br />accomplished in terms of the operations plan? <br />Page 5-17(2) the statement that "the need for a designed underdrain is not <br />applicable" is false. In fact a certified designed with pictures showing the <br />construction of the underdrain is required per Rules 4.10.3 and 4.10.4. <br />Response <br />The vertical and horizontal survey control will be established when mining <br />• resumes. The reference to the lack of need for an underdrain design refers <br />to the fact that the system was engineered, approved, and implemented. <br />The text has been modified to reflect the same.
