Revised Adequacy Review No. 2
Blue Flame Mine
C-81-053
Application Form
1. The amount of "affected acreage" is listed at 25.1 acres whereas 40.0
acres are to be "permitted". Please specify the reason for the
difference in acreages.
2, Throughout this permit application, Mr. Fidel Lobato and Mr. Carwin
Bleidt are listed as the permit applicant and resident agent,
respectively. However, Mr. Timothy Meiers is the entity that signed
the application form. We will need either a statement from Mr, Lobato
or Mr. Bleidt specifying Mr. Meiers is an "individual legally
authorized to bind the operation to this application" or the
application form signed by Mr. Lobato or Mr. Bleidt.
2.03.3 Format and Supplemental Information
The following request from our March 3, 1986 adequacy review was not
addressed. Please do so at this time.
"Please submit the information required in this rule, specifically Rule
2.03.3(4) and (6),
2,03.4 Identification of Interests
1, Rule 2.03.4(1)(b) requests information pertaining to both the .
legal or equitable owner of record of the coal to be mined" and the
"...legal or equitable owner of record of ...acres to be affected by
surface operations and facilities incidental..." for underground mining
activities, Please provide this latter information.
2. Nap A-1 depicts surface ownership in Section 31. Blue Flame needs to
depict the location of the proposed permit area on this map.
3, The June 11, 1984 permit application lists surface owners as being Mr.
Lawrence Huntington and the Ute Indian Tribe; whereas the latest
submittal specifies only the Ute Mountain Ute Indian Tribe. Since Mr.
Huntington is still a landowner in this area, why is he no longer
listed?
