This letter is being written to answer additional questions <br />you raised. <br />Randy Overton of your office has reviewed the information on ground <br />water resources which we obtained from Ron Schiff, a water resources <br />engineer with the Colorado Division of Water Resources. In view <br />of the very small recharge zone above the Rockcastle mine site and <br />the depth at which water was struck during development drilling, <br />Randy agrees that there will be negligible impact from the mining <br />operation on underground aquifers in the area. Therefore, Randy <br />is recommending that no ground water monitoring be required. <br />In regard to any tippling station, as per the joint agreement be- <br />tween the Rockcastle Company, Consolidated Energy, and Electra <br />Coal Company (reference our letter of 18 May 1978), Consolidated <br />Energy and Electra Coal Company are responsible for the tippling <br />operation and for marketing the coal. Responsibility for the coal <br />changes hands at the mine boundary. Therefore, any permits assoc- <br />iated with tippling and/or further transportation of the coal are <br />not the responsibility of Rockcastle and should not interfere with <br />the mining permit from the Colorado Mined Land Reclamation Board. <br />Any required permits associated with tippling will be requested by <br />Consolidated Energy or Electra Coal. <br />Diversion ditches have been located on the premining and mining <br />plan map (see Exhibit C). However, to further explain, the min- <br />ing operation will always advance from the lower elevations to the <br />higher. Thus, water from a precipitation event will naturally <br />gravitate to the holding pond left within the first cut of each <br />mining area or into pits active during the precipitation event. <br />~~II~~I~~I~~~I I <br />
