Box 226, 1st & Colwnbia
Delta, Colorado 81416
Dear i1r. Reschke:
~;
The attached Draft Finliinys Document represents the final stage of tyre
Division's permit review for the Red Canyon I•tine. Items noted as
adequacy issues require information or modifications to the permit which
can and must be submitted prior to permit issuance. These adequacy
issues will not be included in the Final Findings of Compliance.
Information requested by adequacy issues is necessary to allow the
Division to make the required findings of compliance. Stipulations
require information to be submitted subsequent to permit issuance and
will probably be included in the final document.
Une significant issue vlhich must he resolved prior to publication of the
Division's proposed decision regards the Delta load-out facility.
Upon permit issuance, the Division will assume regulatory jurisdiction
over the load-out. Information regarding operations and sediment control
at the load-out has been provided. However, certain additional
information should be submitted prior to preparation of the final
Findings Document. The application form should include the general
location and acre aye of the load-out. A legal description and
information on ownership/right-of-entry and an updated air pollution
control plan (as required by the Health department) should be
incorporated in appropriate sections of tfre application.
Also, it is apparent from 14ap Ho. Z.U5.3(7j-1 that the proposed permit
area at the load-out is v+ithin IUD feet of puulic roads and within 3UU
feet of private residences in Delta.
Pursuant to Rule 2. U7.G(2)(d)(v), all owners of occupied dwellings vlithin
3UU feet of the proposed permit boundary must provide a written waiver(s)
consenting to Lire surface coal Inininy operations closer than 3U0 feet.
The waiver(s) must be submitted to the Division prior to permit issuance.
.1: ~~ !'r ,~I,~n.,. it II~iiL rinn r l r •'1., ~.~ ,n !:1 . ,.r I1,..,~.. r L•, I ,,, .
