C-041-82 <br />PROPOSED RESPONSE TO DRAFT DECISION DOCUMENT <br />General Provisions <br />A final comprehensive document will be prepared within three (3) months of <br />permit application approval. <br />Legal, Financial, and Compliance <br />An explanation acceptable to the Division of the role of Western Associated <br />Coal will be provided as part of the permit application. <br />Hydrologic Balance <br />The permit application will be revised to include the approved sediment <br />control plan. Sediment ponds which have already been constructed according to <br />the approved plan will be certified by a registered professional engineer. <br />Alluvial Valley Floors <br />Evidence from an alluvial valley floor reconnaissance level investigation <br />will be provided [o the Division for the Cottonwood and Rapid Creek and the <br />adjacent area. <br />Coal Processing Waste <br />The permit application will be revised to include the information in <br />approved minor revision for return of coal processing waste to abandoned under- <br />ground workings. <br />Roads <br />Roadway drainage and cross-drainage culvert calculations are provided in <br />Appendix F of Volume VI of the Permit Application Addendum. <br />Subsidence <br />Proper descriptions of the Rapid Creek and Cottonwood drainages will be <br />provided by the alluvial valley floor evidence mentioned previously. Further, <br />surficial geology and hydrology discussions will be provided to allow determina- <br />tion of the potential relationship between ground subsidence and any renewable <br />resource lands. <br />Regarding Dr. Abel's backfilling recommendation for Ute Water District's <br />facilities, Powderhorn has revised mine plans to exclude mining beneath the <br />facilities. The application now includes design criteria for adequately pro- <br />tecting structures for room and pillar methods. It is Powderhorn's plan that <br />
