<br />Maps - Rule 2.10 <br /> <br />1. There is some question regarding the permit boundary. The maps <br />include the tipple area and lands released from bond within the permit <br />boundary. It is the Division's understanding that the tipple was to be <br />permitted separately. Lands released from bond are not under the <br />Division's jurisdiction and do not fit into the permit area definition <br />(Rule 1.04). Please provide the legal description for the permit area. <br />Maps not showing the correct permit boundary will have to be changed. <br />RESPONSE: <br />All maps have been revised to shoe the proposed permit boundary <br />for Energy Mine #3. A Legal description of the permit boundary is <br />included on the enclosed revised page 2.03-38a. <br />Land Use - Rules 2.04.3, 2.05.5, and 4.16 <br />1. CYCC has designated the major land use category within the permit <br />area to be pastureland. Lando designated by this category are <br />characterized by big sagebrush, snowberry and various native grass <br />species. This vegetation type is not usually associated with land that <br />is actively managed for grazing, browsing or for occasional hay <br />production as required by the pastureland definition (Rule 1.04(71)(b). <br />CYCC has made reference to the active management of the native <br />pastureland but there is no discussion describing what those management <br />practices are. Please discuss in detail the methods by which the native <br />-1- <br />
