PART 1 - COMPLETENESS ISSUES <br />This part identifies those requirements which must be addressed before <br />the permit application will be complete. <br />Rule 2.03.8 - Permit Term Information <br />1. The permit area must include all areas that will be affected by the <br />mining operation. The permit area identified in the application does <br />not include all affected areas. The areas that could be affected but <br />were not included as part of the permit area in the application are: <br />the surface above the underground workings that might be affected by <br />subsidence and the entire length of the contour ditches that are <br />being installed above the hiyhwall. The applicant must revise the <br />application as all areas that could be affected by the mining <br />operation are included within the permit area. <br />2. On page 5 of the application, Twin Pines Coal Company, Inc, has <br />requested a permit term of fifteen years. The applicant must <br />demonstrate, in accordance with Rule 2.03.8(3), that this term is <br />reasonably needed to obtain necessary financing for equipment and the <br />opening of the operation. This need must be confirmed in writing by <br />the applicant's sources for financing as specified in Rule <br />2.01.5(1)(a). <br />Rule 2.04.9 - Soils Resource Information <br />1. The Division could not determine from the soils map presented on page <br />55 of the application if the soil samples were taken from the areas <br />to be disturbed by the Twin Pines No. L Mine. The Division suygests <br />that the applicant show the sample sites and the soil types on a map <br />of the same scale as the facilities map, 1" = 5U'. <br />2. The applicant provided a narrative on the topsoil handling procedures <br />for the proposed mine. This narrative Does not address each <br />requirement of Rule 2.05.3(5). For example, the applicant must <br />specify the depth of material to be salvaged, the volume of each of <br />the materials salvaged and a map of the location where the topsoil <br />will be stored prior to reapplication. The applicant must address <br />all details of Rules 2.05.3(5) and 4.06. <br />3. The soils sampled were analyzed for pH, available water capacity, <br />fragment size, soil erosion factor and texture as presented on page <br />56 of the application. Not all of the required analyses were done. <br />Rule 2.04.9(1)(b) also requires that the soils be analyzed for <br />electro-conductivity (E.C.) and Sodium Absorption Ratio (S.A.R.). In <br />addition because of the potential for acid producing compounds within <br />the overburden, the Division is also requiring an analysis for acid <br />and alkaline producing capabilities for the materials to be used as <br />plant growth mediums. To complete the soils portion of the <br />application the applicant must have the soils tested fur the <br />following additional parameters: E.C., S.A.R. and acid producing <br />capabilities. <br />
