Fred Banta <br />October 1, 1982 <br />Page 2 <br />indicated that you would contact us with further definition on this matter <br />after a conference with everyone on your staff involved in reviewing this <br />part of the permit application. <br />On September 10, 1982, we received a letter of transmittal from Jim Herron <br />to Henry Barbe dated September 3, 1982. The letter (Attachment B) refers <br />to a telephone conversation on September 1, 1982, and an enclosure stating <br />the remaining deficiencies in the Powderhorn permit application. Since the <br />enclosure was not included with the letter, we assumed that Jim Herron was <br />referring to the attachment given to Bill Tate at your office on September <br />3, 1982. <br />On September 15, 1982, you telephoned me to say you had met with your staff <br />to discuss the Division's specific needs toward finalizing the findings <br />document and had a memo from Jerry Zimpfer defining the type of estimate <br />needed to assess the hydrologic consequences of mining (Item 3). You also <br />stated that the Division could draft a monitoring plan for Item 4 which <br />would be included as a stipulation in the proposed decision document. You <br />indicated that you would be sending a letter to me defining the matters you <br />had resolved with your staff. <br />On September 23, 1982, we received a letter of transmittal from Jim Herron, <br />dated September 21, with an inter-office memo from Jerry Zimpfer attached. <br />Attached to Mr. Zimpfer's memo was a very theoretical and complex estimate <br />of the effect of the waste dump on stream quality at CF&I's Allen Mine and <br />Maxwell Mine. This transmittal is included here for reference as Attachment <br />C. <br />The assessments and responses we are submitting herein were developed after <br />carefully considering all the previously mentioned communications with the <br />Division.
