In our meeting we discussed each item with respect to its <br />importance to the Division in completing the findings and proposed decision <br />document and possible approaches to addressing the general concerns expressed. <br />As a result of this meeting, we agreed that since timing of permit approval <br />is so critical to Powderhorn at this time, Items 4 and 5 could be addressed <br />as stipulations in the proposed decision document. The specific needs of the <br />Division for a mitigation plan (Item 5) related to the assessment of probable <br />hydrologic consequences of undermining Rapid Creek and Cottonwood Creek <br />(Item 3a) could not be completely defined, although we agreed that a "worst- <br />case" assessment was somewhat extreme in light of the fact that Powderhorn <br />had completely revised the mine plan to mitigate potential subsidence damage <br />to the creeks by providing protective pillars in the subareas within an area <br />defined by a conservative angle of draw.
