At the Time of Minine Plan <br />Ht. Gunnison No. 1 Mine <br />West Elk Coal Company Inc. <br />nd <br />1. The Office of Surface Mining Reclamation and Enforcement (OSHI2E) has <br />reviewed the operation and reclamation plan portion of the <br />Mt. Gunnison No. 1 mine permit application and determines that it <br />complies with the Surface Mining Control and Reclamation.Act of 1977 <br />(SMCRA), the Federal lands program (30 CFR Chapter VII, <br />Subchapter D), and all other requirements of applicable Federal <br />laws.- (See the environmental assessment and Colorado's decision and <br />findings of compliance.) <br />2. After reviewing the description of the proposed area of the mining <br />plan approval, OSMRE determines this area is: <br />a. Not unsuitable for mining in accordance with section 522(b) pursuant <br />to section 522(a)(2) of SMCRA. (See the environmental assessment <br />and Colorado's decision and findings of compliance.) <br />b. Not unsuitable for mining in accordance with section 522(b) pursuant <br />to standards set forth in section 522(a)(3) of SMCRA. (See the <br />Bureau of Land Management's letter dated Tune 11, 1981, the U.S. <br />Forest Service's letter dated October 3, 1986, the environmental <br />assessment, and Colorado's decision and findings of compliance.) <br />c. Located on Federal lands within the boundaries of the Gunnison <br />National Forest. Rowever, based on OSMRE's analysis and on the <br />concurrence of the Forest Service, the surface operations and <br />impacts of the Mt. Gunnison No. 1 mine are incident to an <br />underground coal mine and will not be incompatible with significant <br />recreational, timber, economic, or other values of the Gunnison <br />National National Forest.
