1. The Office of Surface Mining Reclamation and Enforcement (OSHI2E) has
reviewed the operation and reclamation plan portion of the
Mt. Gunnison No. 1 mine permit application and determines that it
complies with the Surface Mining Control and Reclamation.Act of 1977
(SMCRA), the Federal lands program (30 CFR Chapter VII,
Subchapter D), and all other requirements of applicable Federal
laws.- (See the environmental assessment and Colorado's decision and
findings of compliance.)
2. After reviewing the description of the proposed area of the mining
plan approval, OSMRE determines this area is:
a. Not unsuitable for mining in accordance with section 522(b) pursuant
to section 522(a)(2) of SMCRA. (See the environmental assessment
and Colorado's decision and findings of compliance.)
b. Not unsuitable for mining in accordance with section 522(b) pursuant
to standards set forth in section 522(a)(3) of SMCRA. (See the
Bureau of Land Management's letter dated Tune 11, 1981, the U.S.
Forest Service's letter dated October 3, 1986, the environmental
assessment, and Colorado's decision and findings of compliance.)
c. Located on Federal lands within the boundaries of the Gunnison
National Forest. Rowever, based on OSMRE's analysis and on the
concurrence of the Forest Service, the surface operations and
impacts of the Mt. Gunnison No. 1 mine are incident to an
underground coal mine and will not be incompatible with significant
recreational, timber, economic, or other values of the Gunnison
National National Forest. (See environmental assessment and the
U.S. Forest Service's letter dated October 3, 1986.)
