<br />• Colorado Mined Land Reclamation Division (MLRD) has reviewed the PAP <br />associated with this mining plan modification under the Colorado State <br />program, the Federal Lands Program (30 CFR Chapter VII, Subchapter D) and <br />the Colorado Cooperative Agreement (30 CFR Part 906) and has recommended <br />approval of the mining plan, as modified. Pursuant to the State program <br />and the cooperative agreement, Colorado MLRD approved the permit revision <br />for the proposed operations at the Energy No. 1, Energy No. 2 and Eckman <br />Park mines on September 29, 1985. <br />The operation and reclamation plan portion of the PAP was reviewed by <br />OSMRE for compliance with SMCRA, the Federal Lands Program, and all other <br />requirements of applicable Federal laws. The resource recovery and <br />protection plan xas reviewed by the Bureau of Land Management for <br />compliance with the Mineral Leasing Act of 1920, as amended, and 43 CFR <br />Part 3480. <br />The mining plan approval document included with this memorandum will be <br />in conformance with the Mineral Leasing Act of 1920, as amended, the <br />Surface Mining Control and Reclamation Act of 1977 (SMCRA), the <br />applicable Federal regulations, and the Colorado cooperative agreement. <br />I recommend that you advise the Assistant Secretary for Land and Minerals <br />Management, under 30 CFR Part 746, that the Colorado Yampa Coal Company's <br />Energy Na. 1, Energy No. 2 and Eckman Park mine mining plan, as modified, <br />• is ready for approval. I concur with Colorado MLRD that a bond in the <br />amount of $7,499,000.00 is adequate. <br />I have determined that this action will not have a significant impact on <br />the quality of the human environment. <br />II. Background <br />The Energy No. 1, Energy No. 2 and Eckman Park mines are located in Routt <br />County, Colorado, approximately 25 miles southwest of Steamboat Springs, <br />Colorado and have been operating since 1962. The mines were permitted <br />under the approved Colorado permanent regulatory program in March 24, <br />1980. Since the original approval of the mining plan, there have been no <br />mining plan modifications. <br />The permit revision area associated with this mining plan modification <br />contains approzimately 30 acres, all of which are leased Federal coal <br />(CO-26914)• The surface acreage is non-Federal. Including the permit <br />revision area associated xith this mining plan modification, the Energy <br />No. 1, Energy No. 2 and Eckman Park mines permit area will contain <br />approzimately 6,711 acres. Upon approval of this mining plan, as <br />modified, the approved mining plan area for the Energy No. 1, Energy No. <br />2 and Eckman Park mines xill contain approximately 4,655 acres within <br />Federal leases C-22644, C-20900, C-128433, C-081330, D-052547, C-16284 <br />and C-26914. <br /> <br />
