Recommendation I recommend approval with conditions of the Colorado Yampa Coel Company (CYCC) Energy No. 1, Energy No. 2 and Eckman Park mines mining plan, ae modified. Approval of this mining plan, as modified, will supersede the mining plan approved on March 24, 1980, for the existing Energy No. 1, Energy No. 2 and Eckman Park surface mines. My recommendation is based on the complete permit application package (PAP), updated to November 1, 1985, an environmental assessment of the proposed mining and reclamation operations and alternatives prepared by the Office of Surface Mining Reclamation and Enforcement (OSMRE), a technical analysis, and the administrative record. Approval of the mining plan, as modified, will authorize mining of approximately 31 million tons of Federal coal within the mining plan area which covers 6,711 acres within Federal leases C-22644, C-20900, C-128433, C-081330, D-052547, C-16284 and C-26914, as shown on the maps included with this memorandum. In conjunction with OSMRE'e processing of this mining plan mod ificatian, OSMRE also reviewed the previously approved mining plan and the Federal permit number CO-0003 issued on March 24, 1980, for the Energy No. 1, Energy No. 2 and Eckman Park mines. All terms and conditions of the Federal permit will be covered by the Colorado permit number CO-79-177 and the mining plan approval document. Because the Secretary of the Interior and the State of Colorado have entered into a cooperative agreement which provides for the delegation to the State of the permitting responsibilities for operations on Federal lands pursuant to Section 523 of SMCRA, the previously issued Federal permit will be dissolved upon approval of this mining plan, ae modified. The mining plan approval document contained herein reflects the mining plan as previously approved along with the modification recommended herein for approval. The mining plan approval document identifies the leased Federal coal lands in the previously approved mining plan area along xith the leased Federal coal lands recommended for approval with this modification.
