-6- <br />2. Map L-1 depicts "proposed ditches" above the mine benches. However, the <br />third paragraph on page 7 of Exhibit K discusses how the "removal of <br />surface gangue will allow reopening of surface drainage ditches used for <br />diversion of upslope runoff...". Please address this discrepancy. <br />3. The last paragraph on page 1 of Exhibit K discusses spoil material <br />deposition in the southeast gully. This gully cannot be located on Map <br />L-1 and is more representative of spoil deposition at the National King <br />Coal Mine. Blue Flame should modify this section to reflect actual <br />activities at this site. <br />4. Blue Flame needs to provide a description of the two access roads to the <br />mine benches as requested pursuant to Rule 2.05.3(4). <br />5. Blue Flame should identify any soil medium on the site that would be <br />acceptable as substitute for topsoil since no topsoil was ever salvaged <br />at this site. <br />6. Blue Flame should address the coal handling structures at this site, <br />pursuant to Rule 2.05.3(7). <br />7. Blue Flame should address any coal processing activities proposed for <br />this site and the ultimate deposition of coal processing waste, pursuant <br />to Rule 2.05.3(8). If no coal processing is proposed, a statement to <br />that affect is needed. <br />8. Please provide the design criteria for the "open concrete constructed <br />channel covered with steel rails" to be installed across the access road <br />as addressed on page 3 of Exhibit K. <br />2.05,4 Reclamation Plan <br />1. Paragraph (A) on page 1 of Exhibit L addresses the construction of some <br />new facilities at the site. It is necessary to depict these proposed <br />facilities on Map L-1. <br />2. Exhibit L specifies that the access road will remain after site <br />reclamation to allow for livestock transportation. After inspecting this <br />site, the Division believes Blue Flame's access road would not be <br />utilized for livestock transportation and should be reclaimed. However, <br />this reclamation requirement will be waived if Blue Flame submits <br />notarized letters from each of the owners of record requesting the access <br />road remain after mining ceases. Included in this letter should be a <br />discussion of the rational for wanting to keep the access road. <br />3. Exhibit L specifies that the sediment pond will be graded after the water <br />evaporates upon completion of mining and that the open channels will be <br />filled in three to four years after final reclamation. These proposed <br />activities do not comply with the requirements of Rule 4.05.2. Please <br />modify this section to comply with Rule 4.05.2. <br />
