-6-
2. Map L-1 depicts "proposed ditches" above the mine benches. However, the
third paragraph on page 7 of Exhibit K discusses how the "removal of
surface gangue will allow reopening of surface drainage ditches used for
diversion of upslope runoff...". Please address this discrepancy.
3. The last paragraph on page 1 of Exhibit K discusses spoil material
deposition in the southeast gully. This gully cannot be located on Map
L-1 and is more representative of spoil deposition at the National King
Coal Mine. Blue Flame should modify this section to reflect actual
activities at this site.
4. Blue Flame needs to provide a description of the two access roads to the
mine benches as requested pursuant to Rule 2.05.3(4).
5. Blue Flame should identify any soil medium on the site that would be
acceptable as substitute for topsoil since no topsoil was ever salvaged
at this site.
6. Blue Flame should address the coal handling structures at this site,
pursuant to Rule 2.05.3(7).
7. Blue Flame should address any coal processing activities proposed for
this site and the ultimate deposition of coal processing waste, pursuant
to Rule 2.05.3(8). If no coal processing is proposed, a statement to
that affect is needed.
8. Please provide the design criteria for the "open concrete constructed
channel covered with steel rails" to be installed across the access road
as addressed on page 3 of Exhibit K.
2.05,4 Reclamation Plan
1. Paragraph (A) on page 1 of Exhibit L addresses the construction of some
new facilities at the site. It is necessary to depict these proposed
facilities on Map L-1.
2. Exhibit L specifies that the access road will remain after site
reclamation to allow for livestock transportation. After inspecting this
site, the Division believes Blue Flame's access road would not be
utilized for livestock transportation and should be reclaimed. However,
this reclamation requirement will be waived if Blue Flame submits
notarized letters from each of the owners of record requesting the access
road remain after mining ceases. Included in this letter should be a
discussion of the rational for wanting to keep the access road.
3. Exhibit L specifies that the sediment pond will be graded after the water
evaporates upon completion of mining and that the open channels will be
filled in three to four years after final reclamation. These proposed
activities do not comply with the requirements of Rule 4.05.2. Please
modify this section to comply with Rule 4.05.2.
