Mr. Jim Stover <br />August 9, 1996 -New App./Bowie 2 <br />Page 19 <br />Paragraph 1 <br />No comment was required by BRL -none was tendered. <br />Paragraph 2 <br />The amendments proposed by BRL to pages 14 and 15 of Exhibit 15 clarify the design <br />intent of the outcrop barrier pillar and resolve our earlier adequacy concerns. <br />Chimney Collapse Prediction <br />91. New Section 1.8, added to Exhibit 15 by BRL, addresses the possible implications of near <br />outcrop faulting for possible chimney collapse occurrence. Our earlier adequacy concern <br />has been resolved by the proposed amendment to Exhibit 15. <br />2.1 SUBSIDENCE IIvIPACTS -LAND USE <br />Paragraph 1 <br />BRL's amendment to page 18 of Exhibit 15, and the related mitigations presented within <br />the SUBSIDENCE HANDBOOK, acceptably resolve our earlier adequacy concern regarding <br />the potential land use effects of subsidence. <br />2.2 SURFACE WATER <br />Paragraph 1 <br />BRL's proposal that "surface modifications of the surface drainage and ponds could be <br />made in cases of any occurrence of subsidence cracks", has been supported by their <br />amendment to the monitoring plan, which will allow timely detection and implementation <br />of the appropriate mitigative techniques. <br />2.3 GROUNDWATER <br />Paragraph 1 <br />BRL asserts throughout the application that no significant water resources exist within the <br />overburden or on the surface of the permit area, and that no appropriated springs issue from <br />the affected area. BRL further asserts that none of the water that issues from the ephemeral <br />drainages is appropriated. However, all of these waters may be considered tributary to <br />adjudicated water rights.
