Popkess-Vawter (Kazki and Klavetter on Map 1) is not listed as a mineral owner. Please <br />review the requirements of Rule 2.03.4(6) and Rule 2.10.3(1)(a) and modify Map 1 and the <br />permit text to accurately, cleazly, and distinctly depict the ownership of all coal to be mined <br />and the surface ownership within the permit boundary and adjacent to the permit boundary. <br />4. Permit text indicates a house on the Klavetter/Kazki parcel (now Popkess-Vawter) but none <br />is shown on Map 1. (Rule 2.10(1)(d)). Also, some buildings may have been constructed <br />since Map 1 information was complied (see Ravensberg pazcel). Please update this <br />important information on maps and in pemut text. <br />5. Please update the permit text with the MSHA identification number. <br />6. Please submit a certificate showing personal injury and property damage insurance is in <br />force as required by Rule 2.03.9. <br />7. Please update the information submitted under Rule 2.03.10. <br />Rule 2.04 Environmental Resources <br />8. The Horseshoe Mine is shown on Map 4 as historic mining within the permit area but is not <br />identified (other than in the table) in permit text. This historic mining is very close to <br />privately owned surface lands. Please ensure that information on all historic mining activity <br />within the proposed permit area is included as required by Rule 2.04.3(3). <br />9. The Division is currently asking for additional clarification from the State Historic <br />Preservation Office on the potential need for surveying the proposed disturbed area for <br />cultural resources. If any additional information is required regazding cultural resources, we <br />will contact you. (Rule 2.04.4) <br />10. Please submit the chemical analysis of the roof and floor in accordance with Ruie <br />2.04.6(3)(a)(iii)(D) for the exploration holes drilled in 2005, <br />11. Please submit the thickness and engineering properties of clays or clay shales, if any, in the <br />stratum immediately above and below the coal seam to be mined (Rule 2.04.6(3)(a)(iii)(E). <br />12. Please update text on page 2.04-13 under the heading Hydrology Description to include a <br />reference to the Exhibit that contains the compiled hydrology data collected over the <br />baseline monitoring period. Also, submit any additional baseline hydrologic information <br />collected over the baseline monitoring period for inclusion into this exhibit. <br />13. Exhibit K identifies numerous registered wells within, and in close proximity to, the <br />proposed permit boundary on the northwest, northeast, and southeast. Please submit a table <br />or permit text that details ownership of these wells, uses, and reference to location in <br />accordance with Rule 2.04.7(1)(a)(iv). <br />14. Additional discussion and analysis is required _regazding the potential for mine-induced <br />
