<br />•Tah 3, page T was revised to clarify that NGTI is the owner/applicant and PCC is the <br />designated operator. <br />1. Identification of Interests <br />Departure dates for the names of owners/controllers for PCC and Peabody Holding <br />identified in the February 19, 1993 PAR letter have been included in Tab 3, <br />Attachment 3-2. <br />2. Emoloyee Identification Number <br />Tab 3, pages 1 end 2, have been revised to include the employer identification <br />number for each name that owns ar controls the applicant. <br />'Tab 3, pages 3, 5 end 6 have been revised to reference new Exhibit 3-2 (see Item <br />No. 11). <br />•Teb 3, pages 3-4 and b-7, were revised to delete the qualification on surface, <br />coal, and other mineral ownership by HGTI. HGTI now owns the loadout real property, <br />facilities and permits identified in the sales agreement. <br />•The section entitled "Holders of Record of Any Leasehold Interest Within the Permit <br />Boundary" on page 5 of Tab 3 has been updated to reflect the lease agreement between <br />HCTI end PCC to allow PCC to operate the facility. <br />3. Deeds- Titles and Right of Entrv <br />The Right of Entry end Operation Information section of Tab 3 (page 8) was updated <br />to explain owner/operator rights of entry end operation. Appendix 3-4 was updated <br />to document these rights and entitlements. <br />4. Chance in Legal Description <br />The application form (page 2) and Appendix 3-1 were revised to correct the legal <br />description in Section 22. <br />5. Chance in Affected Acres <br />The application fee issue was resolved in a meeting between HGTI and DMG on February <br />10, 7993. Note also that the effected acres have been updated to reflect the <br />incidental permit boundary change in the application form (page 2), Appendix 3-1 <br />2 <br />
