Specifically, how will this drainage be diverted <br />around the face-up area and the details of how this channel is to <br />be reconstructed after mining including channel geometry, channel <br />gradient, and a demonstration that the reconstructed channel and <br />flood plan can safely pass the peak flow from a 100 year storm event. <br />N. Acreage of Disturbed Area <br />1. There are discrepancies in disturbed acreage between Map I-1, <br />Map IV-9, Map III-10 and Drawings IV-Z9, thru IV-25. <br />a. Part of the drainage sediment control system is outside of <br />the blue area shown on Map IV-10. Section 817.42(a)(4) allows <br />exclusion of such structures only for the purpose of calculating <br />runoff and sediment storage acreage. These structures are included <br />as affected acreage for the purpose of calculating disturbed area <br />and reclamation costs. Acreage and reclamation costs should be <br />adjusted accordingly. <br />b. Cut and fill work for the Eagle q5A mine is outside of <br />the Llue boundary.The same comment applies to the shop area and <br />the Eagle q9 Mine. ' <br />c. The Eagle q9 Rock Dust Tank must be included in the disturbed ~ <br />area boundaries. ~ ~~ <br />d. There are major discrepencies in the boundaries between <br />pre May 3, 1978 and post May 3, 1978 disturbance in the Williams <br />Strip q2-Eagle q9A area between Map y-1 and Map IV-10. Map 2-2 <br />includes considerable more acreage as post May 3, 1978. This <br />discrepency must be clarified. This is particularly important since <br />this is the only area mined by Empire Energy after May 3, 1978 for <br />which some area is not to be included within this permit. Therefore, <br />information should be provided which accurately shows when all areas <br />in the Williams Strip No. 2 mine were mined, clearly depicting <br />pre May, 1978 disturbance from post May, 1978 disturbance. This <br />can be a mine progress map or similar document. The final date of <br />deposition of overburden in the overburden disposal area should also <br />be provided. <br />I. Pre-Law Areas (IV-s Pond IV-62) <br />Staff calculations of pre-Iaw areas disturbed by Empire Energy <br />do not confirm the 17I acre figure provided.
