Box 68 <br />Craig, Colorado 81625 <br />RE: Eagle Mine Complex <br />Permit #79-190 <br />Dear Mr. Self: <br />As I'm sure you recall, even though the Eagle Mine Complex permit appli- <br />cation was formatted and written to address the final regulatory program, <br />the Division could not make a finding of compliance under the final pro- <br />gram and as such Empire Energy Corporation agreed to an interim program <br />permit application approval. It was further agreed, at the time of permit <br />application approval, that the Division would detail in writing exactly <br />what portions of the application, in the Division's judgment, given our <br />present understanding of the final regulatory program, are in compliance <br />with the final regulatory program and what sections are only in compliance <br />with the interim program. The purpose of this agreement was to minimize, <br />to the extent possible, additional paperwork associated with the repermit- <br />ting of this operation under the final program. The remainder of this <br />letter carries out this purpose on a regulation by regulation basis. <br />I. Legal, Financial Compliance Information (Section 2 of the application) <br />30 CFR 782 - State Equivilent Proposed Rule 2.03• <br />All of this section was found to be in compliance with the final regu- <br />lations with the following exceptions (sections refer to section in <br />the application): <br />1. Section 2.1.8 - Statement of Ownership; <br />2. Section 2.2 - Compliance Information; and, <br />3. Section 2.4 - Areas Designated Unsuitable for Mining. <br />1. and 2. above will have to be re-reviewed for the new principal <br />shareholder at the time of final program submission. Compliance <br />information will be required for all surface coal mining operations <br />"controlled by or under the common control (of) the applicant," <br />(30 CFR 782.14c). <br />
