J- Geology (2.04.6) 1, The applicant has requested a waiver from the requirements of Rule 2.04.6(2)(a)(iii), Section 2.04.6(2)(b) states that this waiver may be granted provided that the Division makes a written determination that the information required is unnecessary because other equivalent information is available in a satisfactory form. Asa basis for the waiver request, the applicant has referenced the Blue Flame Coal Mine permit application (C-81-053) and the National King Coal Mine permit application (C-81-035). The Blue Flame application does not contain the appropriate geochemical information, therefore, this reference will not be considered further. The National King Coal Mine application contains two geochemical analyses, one for the coal seam and one for "Ash (Roof and Floor)". The Roof and Floor analyses does not quantitatively determine the concentrations of such parameters as iron, sodium, sulfur, magnesium, potassium or calcium. Furthermore, the analyses performed by Commercial Testing and Engineering Company did not quantitatively determine the marcasite or sulfur concentrations of the coal, as required by the regulations. The National King Coal Mine application does contain an analyses of the pyrite content of the coal, The Division cannot make the written determination required by 2,04.6(2)(b) because equivalent geologic information does not appear to be available. Therefore, based upon information available to the Division in the form of permit applications and other geologic investigations, a waiver of the requirements of 2.04,6(2)(a)(iii) cannot be made at this time. 2. To satisfy the requirements of 2.04.6(2)(a)(iii)(c) the applicant should analyze coal samples for the percent pyritic sulfur, sulfate sulfur and percent organic sulfur of the coal seam. Percent pyrite and total sulfur content have either been determined from samples obtained from this site, or are referenced from the National King Coal permit. Therefore, it is not necessary to reanalyze these two parameters. A coal sample could be obtained from within the mine, provided that the coal sampled was relatively fresh; that is, not exposed at a cut or face for an appreciable length of time. 3. As the highwall at the face-up area has been cut through overlying strata down to and including the mined seam, the applicant must satisfy the requirements of Rule 2,04.6(2)(a)(iv), The application (Section 2.04) generally addresses 2.04.6(2)(a)(iv)(A) and (B), however sub-sections IC) and (D) must also be addressed, Section 2.04.1(2)(a)(iv)(C) may be addressed by sampling the existing Roof and Floor of the La Plata Number 1 for textural analysis (percent sand, silt and clay).
