J- <br />Geology (2.04.6) <br />1, The applicant has requested a waiver from the requirements of Rule <br />2.04.6(2)(a)(iii), Section 2.04.6(2)(b) states that this waiver may be <br />granted provided that the Division makes a written determination that <br />the information required is unnecessary because other equivalent <br />information is available in a satisfactory form. Asa basis for the <br />waiver request, the applicant has referenced the Blue Flame Coal Mine <br />permit application (C-81-053) and the National King Coal Mine permit <br />application (C-81-035). <br />The Blue Flame application does not contain the appropriate geochemical <br />information, therefore, this reference will not be considered further. <br />The National King Coal Mine application contains two geochemical <br />analyses, one for the coal seam and one for "Ash (Roof and Floor)". <br />The Roof and Floor analyses does not quantitatively determine the <br />concentrations of such parameters as iron, sodium, sulfur, magnesium, <br />potassium or calcium. Furthermore, the analyses performed by <br />Commercial Testing and Engineering Company did not quantitatively <br />determine the marcasite or sulfur concentrations of the coal, as <br />required by the regulations. The National King Coal Mine application <br />does contain an analyses of the pyrite content of the coal, <br />The Division cannot make the written determination required by <br />2,04.6(2)(b) because equivalent geologic information does not appear to <br />be available. Therefore, based upon information available to the <br />Division in the form of permit applications and other geologic <br />investigations, a waiver of the requirements of 2.04,6(2)(a)(iii) <br />cannot be made at this time. <br />2. To satisfy the requirements of 2.04.6(2)(a)(iii)(c) the applicant <br />should analyze coal samples for the percent pyritic sulfur, sulfate <br />sulfur and percent organic sulfur of the coal seam. Percent pyrite and <br />total sulfur content have either been determined from samples obtained <br />from this site, or are referenced from the National King Coal permit. <br />Therefore, it is not necessary to reanalyze these two parameters. <br />A coal sample could be obtained from within the mine, provided that the <br />coal sampled was relatively fresh; that is, not exposed at a cut or <br />face for an appreciable length of time. <br />3. As the highwall at the face-up area has been cut through overlying <br />strata down to and including the mined seam, the applicant must satisfy <br />the requirements of Rule 2,04.6(2)(a)(iv), <br />The application (Section 2.04) generally addresses 2.04.6(2)(a)(iv)(A) <br />and (B), however sub-sections IC) and (D) must also be addressed, <br />Section 2.04.1(2)(a)(iv)(C) may be addressed by sampling the existing <br />Roof and Floor of the La Plata Number 1 for textural analysis (percent <br />sand, silt and clay). Section 2, 04,6(2)(a)(iv)(D) may be satisfied in <br />two (2) steps: <br />
