Dear Mr. Self:
The Division has determined the Eastside Mtne permit application to be
incomplete for the reasons specified belov.

1. The proposed newspaper publication does not contain a description of the
exact boundaries of the proposed permit area as required by Rule
2.07.3(2)(b)(11) and does not identify the owner of the land to be affected by
the proposed operation as required by Rule 2.07.3(2).
2. The application does not contain a detailed geologic map and cross
sections of the permit and adjacent area as required by Rule 2.04.6(2)(a)(i)
and (it). Rule 2.10 requires that permit area maps be at a scale of 1:6000.
The alluvium of Harvey Gap Drainage must be mapped, and the depth, width, and
occurrence of ground water in the alluvium must be described.
3. The application does not contain chemical and physical analyses of
strata immediately above and below the coal seam to be mined, or other stratum
which would be affected. Given the mining plan at Eastside, analyses of shale
splits and rib material which would be disposed of on the surface must be
provided.
4. The application does not contain the results of a geotechntcal
investigation of the proposed waste disposal site as required by Rule
2.05.3(9) and Rules 2.05.3(6)(b) and (c}. This information must be submitted.
5. Limited site specific ground water information is provided 1n the
application Information from at least one bore hole must be provided to
document the presence or absence of ground water in the sandstone strata
overlying and underlying the coal seam to be mined. One year of ground water
level and ground water quality baseline data is requtre:to characterize season.

6. Before the application can be deemed complete, a full year's data an
water quality and flows to Harvey Gap Drainage must be collected and included
in the application. This information is necessary to comply with Rule
2.04.7(a), which requires information sufficient to identify seasonal
variations 1n surface water quality and quantity within the proposed permit
and adjacent areas.
