<br />_„_ <br /> <br />X. Fish and Wildlife (2.04.11. 2.05.6(2). 6.18) <br />1. The applicant refers to a meeting with the Colorado <br />Division of Wildlife on March 3, 1982 where it was decided that <br />no additional wildlife information would be necessary (page <br />2.04-28). A lettec from the D.O.W. verifying the decision <br />reached in the March 3, 1982 should be incorporated into the <br />permit application. <br />XI. F.xnlosivea (2.05.3(6)(a), 4.08) <br />1. Staff inspections have detecmined that blasting <br />techniques, such as stemming and sequency of detonation, have <br />been modified at the operations currently permitted under <br />Permit No. 79-177, which is referenced as proof of conformance <br />within this application. The applicant should make the <br />appropriate amendments to the eziating permit No. 79-177. <br />XII. Undecacound Development Waste (2.05.3(9). 4.092 <br />1. The applicant proposes to place underground development <br />waste within the existing pit remaining from the final cut of <br />the £necgy No. 1 surface mine, immediately to the west of the <br />portal development aces. The applicant observes that stability <br />of these materials is not a concecn, because they will <br />eventually be covered with backfilled spoil and will exist <br />below final grade. Elowevet, the applicant must demonstrate <br />that no hazard will exist in regard to the adjoining portals <br />and that the water quality of the affected area will not be <br />jeopardized. <br />XIII. Mine Facilities, Coal Handlinc Structures. Support <br />Facilities (2.05.3(3). 2.05.3(7), 4.01. 4.04) <br />1. On page 2.05-14 the applicant states that a separate pile <br />will be used to hold the mine development waste rock. The <br />applicant should address the location, use, maintenance and <br />removal of the waste rock pile. Additionally, the applicant <br />should address the location, construction maintenance and <br />removal of the polebarn and the location of power and ware[ <br />lines should be indicated on a map in accordance with Rule <br />2.05.3(3)(a). <br />2. The applicant should address which structures discussed <br />in the previously approved Permit No. 79-177 are to be used in <br />conjunction with the Foidel Creek mine in accordance with Rule <br />2.05.3(3)(b). <br />
